Welcome to the Eastern Market website (the “Site”) operated by Eastern Market Partnership (“Eastern Market" or “We”) and consisting of content provided by Eastern Market, affiliated companies, and third parties. Eastern Market maintains this Site for information, education, and communication. These website terms and conditions (“Terms of Use”) apply to your access and use of the Site.

1. General

a) The Terms of Use set forth the terms and conditions that apply to use of the Site by each end user thereof ("End User" or “You”). IF YOU ARE DISSATISFIED WITH THE SITE OR WITH THE TERMS OF USE FOR ANY REASON, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE. Eastern Market will control the defense of any claim to which this indemnity may apply, and in any event, you shall not settle any claim without the prior written approval of Eastern Market.

Eastern Market will endeavor to respond promptly and appropriately with respect to communications we receive. However, any communication or material you transmit to the Site or Eastern Market by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Eastern Market respects the intellectual property rights of others, and we ask our End Users to do the same. These terms are governed by the and construed in accordance with the laws of the State of Michigan and the laws of the United States, without giving effect to any conflict of law principles.

17. Waiver

No waiver of any provision of these terms by us shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.
